WHAT PRECAUSTIONS SHOULD ONE TAKE WHILE ACCEPTING GIFTS FROM RELATIVES?

I m a govt employee in tax limits and filing my returns regularly. my wife is a housewife having PAN card but not filing returns as she is having no income. My father in law ( father of my wife) is a farmer and having only agriculture income . He does not have pan card nor he files return .Now question is---

1. my father in law wants to give cash gift of 2 lakh to me for purchasing a house? Can he do so?What will be tax liability of both of us in that case?
2. If he gives cash gift to my wife( his daughter) what will be tax liability of both?
3. What is better option of gift from tax point of view....should he give gift to me or my wife....?

I have already answered the general query regarding taxation of gift .I suggest you read When GIFTS are Exempt from income tax ?

Gift from relative is totaly tax free. This is provided in section 56(2) of the I T Act . Therefore, any gift received by you from your father-in-law is tax free irrespective of the amount you receive. So whether you or your wife who is daughter of your father-in-law receive gift from him , is totally tax free. Therefore from taxation point of view , it hardly matters whether you receive the gift or your wife receive.
 
 
Precaution
 
Although the Income Tax Act has given exemption to gifts received from relatives, yet the Income Tax Department has all the powers to p-robe the genuineness of the gift. That is, the source of the fund will always be question.
 
  1. Get the Gift by Cheque or draft
  2. Get a Gift deed wherein following points must be written clearly:
  3. Who is the donor, his complete address.
  4. Who is the donee and his complete address.
  5. The relationship between Donor & Donee
  6. The Gift deed should be attested by Notary public who is easily found at the Court in your city

ASIN REPLACES VIDYA BALAN

The constant postponement of the film Chenab Gandhi being produced by Sanjay Leela Bhansali and directed by Vibhu Puri, has led to the actors being in a constant stage of doubt on whether the film will ever take place. And now the latest casualty is said to be Vidya Balan who has moved out of the project.

Asin replaces Vidya Balan

It was Harman Baweja who had to go out of the film first because the dates clashed and he was replaced by John Abraham in the film. And now we hear that Vidya has moved on from the project and may find herself replaced by Asin who has been making waves in Bollywood.  We are still wondering what the reason for the postponement of the shootings is and would like to know it as much as the stars who are playing musical chairs in the film.

IS TDS ON PAYMENTS TO FRIEND AS CONSULATNCY FEE NECESSARY?

Hi, I have a proprietorship concern. I have to pay 50% of the profits to a friend of mine who helps me in the conduct of business. He desires that that money be paid to him as consultancy fee. I do not have any registration other than PAN card. He is also not registered anywhere other than having a PAN card. Kindly let me know what registration do I require and how much I should deduct from his payment. Thanks in advance for the kind assistance, Regards, Prasad

 

In case of payment of consultancy fee, tax may be deducted at source as per sextion 194J of the I T Act . But that is only when the sales turnover of the business exceeds Rs 40 lakhs in case of trading business and if you har carrying in profession unde the proprietroship concerne , then the sales turnover should excced Rs 10 lakhs .

So the point to check in you case is the turnover . In case , you find that the turnover exceeds the specifed amount (RS 40 Lakhs or 10 lakhs as the case may be ), you need to regsiter for TAN .Read for how toget the TAN online

WILL I HAVE TO FILE RETURN FOR RENTAL INCOME IN INDIA AND PAY TAX IN INDIA & USA BOTH?

I am an NRI and  USA citizen. I received house from  my father , after his death.I am getting some rental income from this house . D I have to file income tax return or I can show this income in my USA return.Do I need a PAN ? If yes, how to apply?

There is Double Taxation Avoidance Agreement between India and USA.  Article 6 of the said agreement is related to earning from immovable property. As per this Article , the country in which the property is situated , may tax the said rental. The said article reads as under


Article 6 - Income from immovable property (real property) - 1. Income derived by a resident of a Contracting State from immovable property (real property), including income from agriculture or forestry, situated in the other Contracting State may be taxed in that other State.
2. The term immovable property shall have the meaning which it has under the law of the Contracting State in which the property in question is situated.
3. The provisions of paragraph 1 shall also apply to income derived from the direct use, letting, or use in any other form of immovable property.
Since the property is situated in India, rental income out of it is taxable in India. For the FY 2009-10 ,the basic exemption is up to RS 1,60,000 . Therefore , if the rental income received by you or accrued to you and any other income arising in India e.g interest  exceeds Rs 1,60,000 only in that case , you are supposed to file return in India.
Will there be double taxation?
No , if any tax is paid in India on rental income and that rental income is also taxed in USA , then as per Article 25 of DTA  , USA will allow you credit fr the tax paid in India. Read the excerpt of the agreement
Article 25 - Relief from double taxation - 1. In accordance with the provisions and subject to the limitations of the law of the United States (as it may be amended from time to time without changing the general principle hereof), the United States shall allow to a resident or citizen of the United States as a credit against the United States tax on income
(a) the income-tax paid to India by or on behalf of such citizen or resident ;
